Legal
Terms & Conditions
These Terms and Conditions (“Terms”) govern your use of graveslegalco.com and any page, form, or feature linked from it (the “Site”). The Site is operated by Graves Legal LLC, a Nebraska limited liability company (“the Firm,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Attorney advertising
The Site is attorney advertising. Aaron Graves is licensed to practice law in Nebraska. The attorney responsible for the Site’s content is Aaron Graves, Graves Legal LLC, 1125 Q Street, #503, Lincoln, Nebraska 68508. Meetings are by appointment only. The Firm does not claim certification as a specialist in any area of law.
2. Information, not legal advice
Everything on the Site, including practice area descriptions, articles, and answers to common questions, is general information. It is not legal advice. Laws differ from state to state and change over time, so the content may not reflect recent developments or apply to your situation. Articles reflect the law as of their publication date. Do not act, or decide not to act, based on anything on the Site without speaking to a lawyer about your own facts.
3. No attorney-client relationship through the Site
Using the Site, submitting the consultation form, calling, emailing, texting, or messaging the Firm on social media does not make you a client. An attorney-client relationship begins only when you and the Firm have both signed a written engagement letter. Until then, the Firm has not agreed to represent you and is not responsible for protecting any deadline in your matter, including any statute of limitations or filing deadline.
4. Before you are a client
The consultation form, email, and phone are for telling the Firm who you are, how to reach you, and what kind of help you need. Before the Firm can discuss your matter, it must check for conflicts of interest. It does that by asking, at the start of your first conversation, for the names of the people and businesses involved. Please do not send confidential details, documents, or time-sensitive information until the Firm has completed that check and told you it can discuss your matter.
If you share information about your matter before then, the Firm will keep it confidential. You agree, however, that the Firm’s receipt of that information will not prevent it from representing another party in the same or a related matter. The consultation form asks you to confirm this before you submit it.
5. How an engagement works
Every matter starts with a first meeting and a written engagement letter. The engagement letter sets out who the client is, the scope of the work, and how it is billed: a flat fee, a fixed monthly fee, or hourly. If the engagement letter and these Terms conflict, the engagement letter controls for that matter.
6. Results and testimonials
Descriptions of past work and any client comments on the Site describe those matters only. They do not predict or guarantee the result in yours. Every matter turns on its own facts and the law that applies to it.
7. Email, text, and other electronic communications
Email, text messages, and web forms are convenient but not completely secure. By contacting the Firm electronically, you accept that risk for the information you send. Once you are a client, the Firm will discuss secure ways to exchange sensitive documents.
8. Social media
Comments, posts, and direct messages on the Firm’s social media accounts do not create an attorney-client relationship, and the Firm may not see or answer them promptly. Do not use social media to send confidential or time-sensitive information.
9. Acceptable use
You agree not to:
- use the Site for any unlawful purpose;
- submit false information, or information about another person without the authority to do so;
- try to gain unauthorized access to the Site, interfere with its security, or introduce malicious code; or
- use automated tools to collect personal information from the Site or to place an unreasonable load on it.
10. Content and intellectual property
The text, design, graphics, and other content on the Site belong to the Firm unless otherwise noted. The Graves Legal name and logo are marks of the Firm. You may read, share, and link to pages, and quote brief excerpts with attribution and a link to the source page. Please do not otherwise reproduce or republish the content, or use it commercially, without the Firm’s written permission.
11. Links to other sites
The Site may link to statutes, agencies, and other resources the Firm does not control. Those links are provided for convenience and are not endorsements. The Firm is not responsible for the content, accuracy, or privacy practices of any outside site.
12. Disclaimer of warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, the Firm disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. The Firm does not warrant that the Site will be uninterrupted, secure, or free of errors.
13. Limitation of liability
To the fullest extent permitted by law, the Firm is not liable for any loss arising from your use of the Site or reliance on its content, including indirect, incidental, special, or consequential damages. This section does not limit any duty the Firm owes a client or prospective client under the Nebraska Rules of Professional Conduct or a signed engagement letter.
14. Governing law and venue
These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-law principles. Any dispute about the Site or these Terms will be brought in the state or federal courts located in Lancaster County, Nebraska, and you consent to the jurisdiction of those courts.
15. General provisions
These Terms are the entire agreement between you and the Firm about your use of the Site. The Privacy Policy describes how the Firm handles information and is not part of these Terms. Neither document governs any legal representation, which is governed by the engagement letter. If any provision of these Terms is found unenforceable, the rest remain in effect. The Firm’s failure to enforce a provision is not a waiver of it.
16. Changes to these Terms
The Firm may update these Terms from time to time. The “Last updated” date at the top shows the most recent revision. Continued use of the Site after changes are posted means you accept the updated Terms.
